• Cobini is free for non-commercial users (individuals, charities, clubs, etc). A version for commercial entities will come later.
• You are responsible for the content of any classified Advertisements that you create. You agree not to post anything illegal, offensive, etc. If an advertisement is reported as inappropriate, we will remove it from the system.
• Some shops may invite you to make a donation to them. If you make a donation to a shop, that's your choice, and we're sure the shop in question will be grateful.
• Most advertisers are genuine, however, you should take reasonable precautions when responding to advertisements on our websites (e.g. in giving out personal details, parting with your money, etc.)
• Your personal details that we store (email, password, etc.) are not displayed to other users on the system. Exceptions to this are when you do not log in to Cobini and instead use your email address to contact an advertiser, post an item, and for other actions where we need to identify you. In this case, your email address will be used to identify you to other users.

Definitions

The websites 'www.cobini.com' and 'www.cobini-shop.com' (and sub-domains such as 'secure.cobini.com', 'home.cobini-shop.com' etc.) are operated by Cobini Limited, a company registered in England (company number 07008957) whose registered address is: 21 St Thomas Street, Bristol, BS1 6JS, referred to here as 'we' or 'us' ('our' is interpreted accordingly).

Individuals and organisations (referred to here as our 'Customers') may set up a website or web-page(s) on our websites (e.g. 'my-advert-page.cobini-shop.com') referred to here as 'shops', where their users can view, create and respond to advertisements.

By visiting these websites you agree to abide by these terms of use (the 'Terms'). If you do not wish to be bound by these Terms, you should not continue to use these websites.

Ownership

The materials displayed on these website are produced either by us, by our Customers or by our advertisers and the copyright, trade marks and database rights in that material belong either to us or are licensed to us.

Content

We are not responsible or liable for the content of any of the advertisements on these websites (including links to other websites in an advertisement) or the goods or services that the advertisers are offering. We are also not responsible or liable for any material provided by a third party. If you have a complaint about the content of an advertisement you can report the advertisement as inappropriate using the functionality provided on these website. If you have a complaint about any other content you can contact us providing full details of your complaint and we will investigate.

These website may contain links to third party websites either inserted by us, by our Customers or by advertisers. These links are provided for your information and convenience only and we do not necessarily endorse the websites or their contents. We are not responsible for the content of third party websites and accept no liability for them.

Logging in

Some features on our websites will require you to register and/or log-in. Any information you provide will be dealt with in accordance with our Privacy Policy.

Note that if you do not log-in and instead use your email address to identify yourself, your email address will be visible to other users.

Placing Advertisements

If you submit an advertisement to us for inclusion on these websites, you automatically grant us a right to reproduce, modify, edit, publish and distribute the advertisement. By submitting an advertisement you warrant that you are authorised to do so and that you own or are entitled to use the information and materials (eg images) that you submit with the advertisement.

Shops may have an approval process for accepting advertisements; submitting an advertisement to a shop does not mean that the advertisement will be accepted into the shop. The criteria for approval is entirely up to the shop where the advertisement is submitted. The length of time during which an advertisement will be displayed on our websites may vary depending on a number of factors, such as the volume of advertisements on the website(s), the frequency of viewing, etc.

We will not accept advertisements from anyone under 18 years old. By submitting an advertisement, you warrant that you are over 18 years of age.

You will not submit an advertisement that contains any material that is generally accepted as being of an inappropriate nature. This includes material that is illegal, obscene, indecent, pornographic, abusive, threatening, defamatory, discriminatory, liable to incite hatred, in breach of confidence or privacy, or for which you have not obtained all the necessary licences or approvals. We will co-operate fully with any law enforcement authorities by disclosing the details of anyone submitting material which is in breach of these Terms. If your advertisement is reported as 'inappropriate', it will be removed from display while we investigate the report, which we may do on our own or with any other agency, customer, user or individual that we choose.

You indemnify us and hold us harmless against all claims, proceedings, costs, demands, loss, damage or liability however incurred by us arising from any advertisement you submit. We are not obliged to publish your advertisement and we reserve the right (at our absolute discretion) to remove your advertisement at any time without notice.

Responding to an advertisement

If you purchase any goods or services from an advertiser, then your contract in respect of those goods and services is with the advertiser. Neither we, nor our Customers will be liable for any problems you may have with the goods, services of the advertiser. However, if you do experience problems, please let us know by contacting us; this will help us to maintain our quality.

Shop Owners

You are responsible for the advertisements displayed in your shop. This includes advertisements that are created in your shop and those that you receive from other shops by sharing.

In addition to the advertisements that you accept in your shop you grant us permission to display additional advertisements selected by us in your shop; these might be paid or unpaid advertisements. If you object to any of the advertisements we place in your shop contact us and we will remove them.

Your use of the websites

You may print or download the contents of any page of the websites for your own private non-commercial use. You may link to our websites or any pages within our websites (e.g. to a specific advertisement); users following your link may be required to register and/or log in to our website. Other than as set out in the Ownership section above, you may not display, copy, modify, re-use, transmit or distribute the contents of these websites to any third party without our prior consent.

Our advertisers provide their contact details in good faith, you may only use those details to respond to the advertisements, you are not permitted to use the details to send unsolicited emails ('spam') or for any other purpose.

If you want to place or respond to an advertisement, you will need to follow our registration process and you will be provided with a username and password. It is your responsibility to safeguard these and you agree not to disclose them to any other party, nor to let anyone else use them. If you do suspect someone else has used your log-in details, you should change your password immediately and contact us. We have the right to block your access to the websites at any time without notice. If we block your access, we will not be liable for any resulting loss or damage that you suffer.

Donations

When you use our or our Customers' shops and websites you may have an opportunity to make a voluntary donation to the Customer whose Shop you are using. We are not responsible for, nor do we influence, the use any Customer makes of your donation. It is your responsibility to check the validity of the Customer to whom you are making the donation. We are not involved in the process of collecting these donations.

Availability

Whilst we try to ensure that these websites are accessible at all times, occasionally availability may be restricted due to maintenance, repair, system failures or circumstances beyond our control. We will not be liable for any unavailability of the websites or any losses or damage that you suffer as a result of unavailability.

We take precautions to prevent problems but we give no warranty that the websites are error-free or free from computer viruses or malicious code and we will accept no liability in this regard. You are advised to take appropriate measures, such as using an up-to-date anti-virus program, to protect your computer.

General

Nothing in these Terms shall operate to limit or exclude liability for death or personal injury arising from our negligence; nor for fraudulent misrepresentation; nor any liability that cannot be excluded or limited by law.
